Legal Advisory Services

Functions

  • To provide general legal advice, guidance and assistance to the Mpumalanga Provincial Government in all its provincial departments regarding the full spectrum of provincial legislative and administrative competences, as and when requested;
  • To draft formal, written legal opinions to the Mpumalanga Provincial Government in all its provincial departments regarding the full spectrum of provincial legislative and administrative competences, as and when requested;
  • To scrutinise, draft and certify provincial legislation, including the rationalisation of “old order” legislation and the drafting of subordinate legislation;
  • To draft memoranda, contracts, letters and other documents with a legal bearing, as and when requested;
  • To co-ordinate litigation pertaining to the Mpumalanga Provincial Government in all its provincial departments, in close co-operation with the Office of the State Attorney.

The above-mentioned functions are performed in order to attain the following:

  •  to ensure adherence to and compliance with policies, processes and procedures
  •  to provide support to the Premier and the Premier-in-Executive Council
  • to provide administrative support for management purposes
The performance of the above-mentioned functions furthermore seeks to attain, support and enhance the following objectives of the Provincial Growth and Development Strategy (PGDS):

Good governance:

Ensuring and implementing the Public Service Management Framework and preventing and combating corruption and fraud.

It is important to note that, although the Chief Directorate: Legal Advisory Services does not render a direct service to the general public as such, it has, as far as the broad principles of the PGDS are concerned, a vital role to play in ensuring that the legislative framework is in place and is continuously being adhered to and complied with, in order to ensure that service delivery is effectively, efficiently and legally dealt with.

Apart from the furnishing of sound legal assistance, advice and formal legal opinions, the expeditious drafting of sound Provincial Legislation is obviously the most important factor in this regard. The same applies to the provision of legal assistance, advice and formal legal opinions that have a direct or indirect bearing on or link to the PGDS.
